TERMS AND CONDITIONS

These terms and conditions (these "Terms") govern all Grand Slam Baseball Tours tour packages sold by Grand Slam Baseball Tours, LLC. The terms “GSBT”, "we," "us" and "our" refer to Grand Slam Baseball Tours, and the term "you" or "your" refers to the customer purchasing a tour package or otherwise using our services to purchase a tour package. By booking and making a deposit, you are agreeing to be bound by these Terms. You agree that any violation of these Terms may result in (a) the cancellation of your tour package, (b) your forfeiture of any monies paid for your tour package, (c) you being denied access to any of the products or services included in your tour package, and (d) our right to charge you for any costs we incur as a result of such violation.

You represent and warrant that (i) you are the legal age of majority in your jurisdiction and can create binding legal obligations, (ii) you are legally authorized to act on behalf of all persons for whom you are purchasing a tour package (each, a member of your “Traveling Party"), to grant the waivers and releases set forth below on their behalf, and to accept these Terms on their behalf, and (iii) the information supplied by you is true and correct. You are responsible for informing each member of your Traveling Party of all terms and conditions applicable to their tour package arrangements, including, without limitation, furnishing a copy of these Terms to each of them.

Grand Slam Baseball Tours and its affiliates and representative(s) (collectively, its “Representatives”) are acting solely as intermediaries. Grand Slam Baseball Tours and its Representatives are responsible only for making the arrangements for accommodations, services, and events that constitute the tour package, except to the extent that accommodations or services cannot be supplied due to reasons beyond the control of GSBT or its Representatives, as detailed in these terms and conditions. The carriers, motor coach companies, hotels, and other suppliers (“Suppliers”) providing travel, hotel, and other accommodations are independent contractors and not agents or employees of Grand Slam Baseball Tours or its Representatives.

Grand Slam Baseball Tours is not affiliated with any professional team or league.

Payment

Grand Slam Baseball Tours requires a $500 deposit per person at the time of booking in order to make the reservation (the “Deposit”). The final payment is due 90 days prior to the confirmed arrival date. Upon booking a tour package and making the Deposit, Travelers agree to allow GSBT to charge the card used for the Deposit to satisfy the final payment.

Cancellations and Refunds

Grand Slam Baseball Tours requires written notification of cancellation pursuant to the provision contained herein. Cancellations 91 days or more prior to confirmed arrival date are eligible for a full refund. Cancellation notifications received 61-90 days prior to confirmed arrival date are subject to a cancellation fee equal to the initial deposit. Cancellations received 31-60 days prior to confirmed arrival date will receive a 50% refund. Cancellations received less than 30 days prior to confirmed arrival date are not eligible for a refund. GSBT recommends that Travelers purchase trip cancellation insurance to protect themselves from unforeseen circumstances. 

There shall be no refunds given for any unused travel services or any portion thereof.

Grand Slam Baseball Tours reserves the right to cancel any tour at its discretion. In the event that a tour is cancelled, for reasons other than a Force Majeure Event (below), all Travelers booked on that tour will receive a refund of the Deposit or any other payments made. Travelers may elect to receive the funds as a credit toward a future tour package at their discretion. GSBT is not responsible for any payments made by the Traveler to other entities such as, airlines, car services, travel agents, etc.

Documentation

It is the responsibility of each individual Traveler to obtain the documentation required for their trip such as, but not limited to, passports, visas, birth certificates, and photo identification. Grand Slam Baseball Tours is not responsible for any information provided concerning such documentation.

Hotel Accommodations

Travelers agree to be responsible for all incidental charges incurred in excess of those covered by the tour package. All hotels require a credit card or deposit for incidental charges at time of check-in. Grand Slam Baseball Tours reserves the right to substitute confirmed hotels with comparable accommodations at either its own or the hotel’s discretion. You, on behalf of yourself and each member of your Traveling Party, hereby authorize GSBT to share your information and the information of each member of your Traveling Party, including first and last names, with the hotel(s) identified in your tour package description at the time of booking (a "Hotel") to the extent necessary for GSBT to carry out its obligations to you in connection with your tour package.

Requests for specific room types, early check in and late check out are subject to Hotel availability and cannot be guaranteed.

Photograph Release

Grand Slam Baseball Tours reserves the right to take photographs or video during the operation of any tour or part thereof and to use the resulting photography, video, or recordings for promotional or commercial use. By making a reservation with GSBT, the participant agrees to allow his/her likeness to be used by GSBT. If the participant prefers that his/her likeness not be used, he/she must notify us in writing prior to departure of the trip.

Force Majeure

Grand Slam Baseball Tours and its Representatives’ performance under this Agreement may be excused by any events or occurrences beyond their control such as, but not limited to, acts of God, war or threat of war, government retaliation against foreign or domestic enemies, terrorism, government regulation or shutdown, executive order, civil disorder, recognized health threats as determined by the World Health Organization, the Centers for Disease Control or local health agency, disaster, fire, strikes either real or threatened, curtailment of transportation facilities, or any other cause beyond the reasonable control of Grand Slam Baseball Tours or its Representatives, making it from an economic, political, personal safety, or policy basis, illegal, inadvisable, or impossible to perform the tour (a “Force Majeure Event”). Grand Slam Baseball Tours and its Representatives have no liability and will have no obligation to make a refund if a Force Majeure Event occurs.

Disclaimer of Warranties

The information, products, and services published on the Grand Slam Baseball Tours website may include inaccuracies or typographical errors. In particular, GSBT and its Representatives do not guarantee the accuracy of, and disclaim liability for inaccuracies relating to, the information and description of the tour packages with respect to the hotel, air, and other travel products displayed on the website. Grand Slam Baseball Tours and its Representatives may make changes to the information provided at any time, in its sole discretion. Grand Slam Baseball Tours and its Representatives make no representations about the suitability of the information, products, and services provided for any purpose. All information, products, and services are provided “as-is” without warranty of any kind. GSBT and its Representatives hereby disclaim all warranties and conditions with respect to information, products, and services, including all implied warranties and conditions of merchantability, fitness for a particular purpose, title, and non-infringement, to the fullest extent allowable by law.

Limitation of Liability

In no event will Grand Slam Baseball Tours be liable to any travelers for any indirect, special, exemplary, incidental, punitive, or consequential damages arising from or relating to any tour or these terms and conditions, even if GSBT knew or should have known of the possibility of such damages. Grand Slam Baseball Tours total cumulative liability arising from or related to any tour or these terms and conditions, whether in contract or tort or otherwise, will not exceed the amount of fees actually paid to Grand Slam Baseball Tours by the traveler who brings the claim or alleges the liability. The parties acknowledge that these terms reflect the allocation of risk set forth in this agreement, and that the parties would not enter into this agreement without these limitations of liability. GSBT and its representatives are not liable for negligence or willful misconduct of any suppliers or third parties providing services on the tour, or for any personal injuries, death, property loss, or other damages resulting therefrom.

Indemnification

You agree to indemnify us and our affiliates and Suppliers, and any such parties' officers, directors, employees and agents, from and against any losses, damages or other costs, (including reasonable attorneys' fees) incurred by any of us as a result of any claim, cause of action, demand, suit or proceeding resulting from: (a) your breach of these Terms; (b) your violation of any applicable law; or (c) your gross negligence or willful misconduct (each, an "Indemnification Cause"). For the avoidance of doubt, the foregoing indemnity shall apply if anyone in your Traveling Party triggers an Indemnification Cause.

Governing Law

Indiana law shall govern these terms and conditions and the relationship between Grand Slam Baseball Tours, its Representatives, and Travelers, and any claims related to any tour or these terms and conditions shall be brought in a court of competent jurisdiction, located in Hancock County, Indiana. The prevailing party in any dispute shall be entitled to all costs, expenses, and fees (including attorneys’ fees) incurred in connection with the dispute, regardless of whether a lawsuit is filed. Travelers expressly agree to submit to personal jurisdiction in Hancock County, Indiana, and Travelers waive any rights or claims to a trial by jury for any disputes related to any tour, any payments made for a tour, or these terms and conditions.
